Scope and provider

These terms govern your use of P2P Dash, operated by newnow.cool GmbH & Co. KG, Frankfurter Tor 2, 10243 Berlin, Germany. They cover the website and the application. Full provider details are in our imprint.

If you use P2P Dash as a consumer, the mandatory consumer protection law of your country of residence applies alongside these terms and prevails where it conflicts with them.

What P2P Dash does

P2P Dash reads the account statements you export from P2P lending platforms and turns them into an overview of your portfolio. It calculates returns, cash flows and related figures from the data you supply.

These figures are an aid, not a binding statement. We convert each platform's export format into a common structure, and that conversion can go wrong: a transaction type may be unknown to us or categorised incorrectly. The statements from your platform and your tax documents remain the authoritative source.

P2P Dash provides no investment advice and no investment brokerage. Details are in our risk disclosure.

Contract and account

A contract is formed when you register an account and we confirm the registration. The public parts of the website can be used without an account.

To enter into this contract you must have full legal capacity, or the consent of your legal guardian.

Give accurate information when you register, keep your password to yourself, and tell us if someone else has gained access to your account.

Free use and availability

P2P Dash is free of charge. We do not owe you any particular level of availability. Maintenance, technical faults and interruptions can occur, and we may change functions, add them or discontinue them.

The product is in active development. Errors in the processing of your data can happen. Keep your original export files so that you can import them again.

Your obligations

When using P2P Dash you agree to the following:

• Do not give false information about your identity.
• Do not upload data about other people without their agreement.
• Do not attack the service, circumvent its security or attempt to gain unauthorised access.
• Do not retrieve content automatically and in bulk.
• Do not use the service to send advertising or unsolicited messages.
• Comply with the law that applies to you.

Shared portfolios

You can publish a portfolio under a public link. This is switched off by default and is entirely your decision.

You are responsible for what you publish. Do not publish personal data of other people, and do not use a shared page for advertising, solicitation or unlawful content.

By enabling sharing you grant us the right to display the published content on that public page. This right exists solely to operate the sharing function and ends when you switch sharing off.

We may switch a shared page off if there are substantial indications that it is unlawful or breaches these terms. We will inform you and give you the reasons. If you think a shared page is unlawful, write to tim@newnow.de.

Rights in your content

The data you import stays yours. We use it to provide the service to you and, in anonymised and aggregated form, for the statistics described in our privacy policy. We acquire no rights to it beyond that.

Blocking and deletion of accounts

We may block or delete your account if you breach these terms seriously or repeatedly, in particular if you misuse the service, send spam or advertising, or attack its technical integrity.

Where it is reasonable to do so we will warn you first and give you the chance to stop. In serious cases we may act immediately. We will tell you the reason.

Warranty and liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. Liability under the German Product Liability Act remains unaffected.

P2P Dash is provided free of charge. For simple negligence we are therefore liable only if we breach an essential contractual duty, meaning a duty whose fulfilment makes the proper performance of this contract possible in the first place and on which you may regularly rely. In that case liability is limited to the foreseeable damage typical for a contract of this kind.

We are not liable for investment decisions you make on the basis of the figures shown.

Term and termination

You can delete your account at any time in the account settings, without notice and without giving reasons.

We can terminate the contract with 30 days' notice. The right to block or delete an account for the reasons set out above is unaffected.

What happens to your data when your account is deleted is described in our privacy policy.

Changes to these terms

We may change these terms where there is a valid reason, for example a change in the law, in case law, or in the functions of the product.

We will tell you about changes by email or in the application at least 30 days before they take effect. If you do not agree with a change, you can delete your account before it takes effect. Changes that affect the essential content of the contract require your consent.

Final provisions

German law applies. If you are a consumer, this does not deprive you of the protection granted by mandatory provisions of the law of your country of residence.

If individual provisions of these terms are or become invalid, the validity of the remaining provisions is not affected.

These terms are published in several languages. The version in the language in which you use P2P Dash applies to you.
